These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CurbyAI ("we", "us", or "our") concerning your access to and use of the CurbyAI mobile application, web application, and related services (collectively, the "Service"). By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

CurbyAI provides automated, artificial intelligence (AI)-powered interpretations of street parking signs and local parking regulations. THE SERVICE IS PROVIDED STRICTLY AND EXCLUSIVELY FOR INFORMATIONAL, ADVISORY, AND EDUCATIONAL PURPOSES. IT DOES NOT CONSTITUTE LEGAL ADVICE, OFFICIAL DETERMINATIONS, OR BINDING INTERPRETATIONS OF THE LAW. Street sign rules, parking zones, and local regulations change frequently, may be modified by temporary permits, construction zones, holiday schedules, or emergency declarations, and are subject to human interpretation by law enforcement. CurbyAI cannot guarantee the accuracy, completeness, currency, or reliability of any sign analysis. YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR VERIFYING PARKING RULES MANUALLY BY READING PHYSICAL ROAD SIGNS, LOCAL ORDINANCES, AND CONFORMING TO PHYSICAL TRAFFIC LAWS. ALWAYS USE YOUR INDEPENDENT JUDGMENT BEFORE PARKING ANY VEHICLE.

To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. Your use of the Service is entirely at your own risk.

TO THE FULLEST EXTENT PERMITTED BY APPLICPIBLE LAW, IN NO EVENT SHALL CURBYAI, ITS CREATORS, DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSEES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, ARISING FROM OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE. THIS LIMITATION OF LIABILITY SPECIFICALLY COVERS, AND YOU EXPLICITLY WAIVE ANY RIGHT TO SEEK RECOVERY FOR, ANY AND ALL PARKING CITATIONS, TRAFFIC TICKETS, FINES, TOWING FEES, IMPOUNDMENT FEES, BOOTING FEES, VEHICLE DAMAGE, OR PENALTIES OF ANY KIND INCURRED BY YOU IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SERVICE.

You agree to defend, indemnify, and hold harmless CurbyAI, its developers, parents, subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right or local parking laws.

Certain features are restricted to CurbyAI Pro subscribers. Payment will be charged to your App Store, Google Play, or web billing account at confirmation of purchase. Subscriptions automatically renew at the selected rate and billing interval unless auto-renew is turned off or the subscription is canceled at least 24 hours before the end of the current period. All fees are non-refundable.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. You and CurbyAI agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Service (collectively, "Disputes") will be resolved solely by binding, individual arbitration, and not in a class, representative, or consolidated action or proceeding. You and CurbyAI agree that the arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration proceedings shall be conducted on an individual basis, and you explicitly waive any right to participate in class actions or class-wide arbitration.

These Terms and any action related thereto will be governed by the laws of the State of California, United States, without regard to its conflict of laws provisions.
